Terms of Service

These terms are the agreement between you and BillNotch for use of the desktop app, the web dashboard, and the API (together, the “Service”). By creating an account or using the Service, you agree to them. If you do not agree, do not use the Service.

The Service is provided “as is”

BillNotch is a paid product that is still actively improving — we ship changes often, and some features are newer than others. The Service is offered on an “as is” and “as available” basis, without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy of billing totals, or uninterrupted availability. Features may change as the product evolves. Do not rely on it as your only record of billable time — keep your own backups of anything you invoice from.

Your account

  • You are responsible for keeping your password and API keys secure.
  • You are responsible for activity that happens under your account or API keys.
  • Provide accurate sign-up information and keep it current.
  • Notify us promptly if you suspect unauthorized access.

Acceptable use

You agree not to:

  • Use the Service for anything unlawful, or to infringe anyone’s rights.
  • Track other people’s activity without their knowledge and consent — track your own work, or work you are authorized to monitor.
  • Probe, attack, overload, or attempt to gain unauthorized access to the Service or its infrastructure.
  • Reverse engineer or scrape the Service except where that restriction is prohibited by law.
  • Resell or sublicense the Service without our written permission.

Plans, billing, and renewal

BillNotch offers paid subscription plans (currently Pro and Team), billed monthly or annually. Team is billed per active member seat. New organizations start with a 14-day free trial — no card required — after which a paid plan is required to keep using the write features; your data stays readable and exportable either way. Current prices are shown on our pricing page and at checkout.

  • Paid plans are recurring. By subscribing, you authorize us to charge your payment method automatically at the start of each billing period — each month or year — until you cancel.
  • Payments are processed by Stripe; we do not store your full card details. Charges are in the currency shown at checkout and exclusive of any taxes that may apply.
  • On the Team plan, your seat count — and therefore your charge — changes as you add or remove members, and adjustments are prorated.
  • We may change prices or plans. We will give reasonable notice before a change affects a renewal, and the new price applies from your next billing period.

Cancellation and refunds

You can cancel anytime from your billing settings. When you cancel, your plan stays active until the end of the period you have already paid for, and it does not renew after that.

Payments are non-refundable except where a refund is required by law. We do not provide prorated refunds for partial periods or for time you did not use. If you believe you were charged in error, email [email protected] and we will make it right.

Your content

Your tracked time, projects, and other data are yours. You grant us only the limited permission needed to host and process that data to run the Service for you, as described in our Privacy Policy. We claim no ownership of it.

Intellectual property

The Service itself — its software, design, and brand — belongs to BillNotch. These terms do not grant you any rights in it beyond the right to use it as intended.

Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate access if you breach these terms or use the Service in a way that risks harm to others or to the Service. On termination, your right to use the Service ends; deletion of your data follows the Privacy Policy.

Limitation of liability

To the fullest extent permitted by law, BillNotch is not liable for indirect, incidental, or consequential damages, or for lost profits, lost revenue, or lost or inaccurate data, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us in the twelve months before the claim. Some jurisdictions do not allow some of these limits, so parts of this section may not apply to you.

Changes to these terms

We may update these terms as the product evolves. We will update the “last updated” date above and, for material changes, give reasonable notice. Continued use after a change means you accept the updated terms.

Governing law

These terms are governed by the laws of the State of Wyoming, USA, without regard to its conflict-of-laws rules, and the state and federal courts located in Wyoming have exclusive jurisdiction over any dispute, unless mandatory local law provides otherwise.
